eminent domain and bull shit

Arizona lawmakers may become involved in the fight over water wells between Arizona Public Service Co. (APS) and Aztec Land and Cattle Company.
A hearing on the issue was scheduled before the Senate Committee on Natural Resources and Rural Affairs on May 30. It was rescheduled after representatives from both APS and Aztec agreed to meet with a facilitator on that date. The senate committee hearing has been reset to 1:30 p.m. on Monday, June 4.
Senator Jake Flake (R-Snowflake) noted that the meeting with the facilitator was arranged in the hopes that the two companies could reach an agreement.
“Our concern was to get it to settle without a condemnation,” Flake remarked.
He noted that as far as he or anyone else he has spoken with can ascertain, this is the first case in which a private utility company has attempted to use eminent domain laws to try to obtain access to groundwater. Flake noted that the outcome of the case could have extensive ramifications for both utility companies and private landowners.
“That raised a lot of questions here at the legislature,” he said.
It is also why some lawmakers have chosen to become involved, and why Flake hopes that APS and Aztec can reach a settlement out of court. If an agreement cannot be reached, Flake explained that the senate committee hearing will take place and, based on the hearing, new legislation could be introduced. According to Flake, the legislation would likely restrict eminent domain rights so that they could not be used to obtain water.
“There could possibly be a bill prepared to prevent water condemnation,” Flake said.

Hey, come on now, let’s be reasonable … the right to use of “eminent domain” is exclusive abuse of political officials, isn’t it . . . ?

We can't allow private enterprise to exercise “eminent domain” because that would close one avenue of political funding.

Condemnation of private property is the exclusive right of our elected political leaders to assure them of a source of political funding.

Hey, it’s not Kosher to compete with government as it screws the taxpayers.
